Notice of Extraordinary General Meeting

Comunidad de Propietarios Conjunto Señorío de Aloha

In accordance with Article 16 of the Horizontal Property Act (Ley 49/1960, de 21 de julio, sobre propiedad horizontal), all owners are hereby convened to an Extraordinary General Meeting to be held at the following times and location:

  • First call: Thursday 5 March 2026 at 10:00
  • Second call: Thursday 5 March 2026 at 10:30 (with whatever quorum is present)
  • Location: [Community meeting room, Conjunto Señorío de Aloha, Nueva Andalucía, Marbella]

Owners unable to attend in person may appoint a proxy by completing and returning the proxy form enclosed with the original notice. The proxy form must be received by Adenjo Gestión SL no later than 24 hours before the first-call time.


Agenda

Point 1 — Approval of Short-Term Rental Regulations (Normativa de Registro de Alojamiento, NRA)

Presentation and approval of new community regulations governing the short-term rental of apartments within Conjunto Señorío de Aloha. These regulations are proposed in response to the legal framework established by Andalucía for short-term tourist accommodation (Viviendas de Uso Turístico, VUT) and the national Accommodation Registration Number (NRA) system.

The agenda item encompasses:

  1. Explanation of the applicable legal framework (Decreto de la Junta de Andalucía on tourist accommodation and the national NRA registry).
  2. Presentation of the draft Short-Term Rental Regulations (attached as Annex 1 to this notice).
  3. Presentation of Appendix C — Enforcement and Sanctions Framework (attached as Annex 2 to this notice).
  4. Owner debate and vote on adoption of the regulations.

The proposed regulations set out:

  • The process for owners to obtain community approval to operate a short-term rental (VUT licence followed by NRA registration).
  • A 10% surcharge on community fees applicable to apartments operating under a VUT licence, as approved by the community at a prior extraordinary meeting.
  • Obligations on owners and their tenants regarding noise, communal area use, and check-in/check-out procedures.
  • The enforcement and sanctions process in Appendix C, applicable to owners who operate short-term rentals without completing the NRA process or who breach the regulations.

Point 2 — Any other business raised by owners in advance

Owners wishing to raise any additional matter must notify Adenjo Gestión SL in writing no later than 48 hours before the first-call time.

Proxy and attendance instructions

Owners who are not current with their community fee obligations do not have the right to vote, in accordance with Article 15.2 of the Horizontal Property Act. The current debtor list will be available for inspection at the meeting. Owners wishing to regularise their position before the meeting should contact Adenjo Gestión SL.
