At a glance

  • The report dated 31-12-2026, prepared by architect Francisco Manuel López Chacón, assesses structural and safety deficiencies in the Señorío de Aloha residential complex in Marbella.
  • It finds that protective barriers on terraces above the second floor (heights >6 m) are only 100 cm high, below the required 110 cm, and that many railings are easily scalable at 93‑95 cm.
  • The common outdoor flooring is non‑anti‑slip ceramic tiles, and several retaining walls (around the Giralda and Doñana buildings) exhibit cracks, fissures, and in one case total collapse.
  • A pedestrian path near the Mezquita building shows significant settlement and deformation due to inadequate sub‑soil support.
  • Conclusions recommend removal of corroded metal plates on slab edges, replacement of aging waterproofing on terraces, demolition and reconstruction of defective walls and paths, and phased replacement of non‑anti‑slip flooring.
  • The economic estimate totals €2 016 977,67 for material execution, €2 400 203,43 after adding general expenses and industrial profit, and €2 904 246,15 for execution by contract, with detailed cost breakdowns for each building.

Manolete, Marbella, CP 29660 (Málaga) Page 20 of 35 In relation to the parameters set by this document, it is worth highlighting in a summarized form: • If the height is between 0.55m and 6.00m, the protective barrier must be greater than or equal to 0.90m • If the height is greater than 6.00m, the protective barrier must be greater than or equal to 1.10m. Extract from CTE DB SUA 1 • There cannot be support points between 30-50cm and protrusions with more than 15cm of support between 50-80cm. Extract from CTE DB SUA 1 In general, the minimum protection height is not met in almost all the terraces located above the second floor, as there is a height >6m and a parapet with a height of 100cm (<110cm). Similarly, in areas where railings exist, the same problem is found. These have a height of around 93-95cm with respect to the pavement, and their configuration of horizontal bars that are easily scalable, constitute a serious hazard:

Manolete, Marbella, CP 29660 (Málaga) Page 22 of 35 1.5.4 Various in common areas: flooring, walls, and paths • FLOORING Almost all the flooring in the exterior common areas of the buildings are ceramic tiles with square geometry, not being anti-slip (Class 3) as defined in the CTE DB SUA. As mentioned earlier, the Conjunto Señorío de Aloha was built under a previous regulation to the CTE. The current regulations would be applicable in areas where the tiles are replaced with new elements. It is for this reason that the slipperiness of the flooring does not constitute a non-compliance in itself, but it can cause undesirable situations. • WALLS (containment systems) Given the topography of the plot, there is a wide catalog of types of containment walls. However, either due to poor execution or incorrect typology, we find two locations where the containment walls present problems: 1. Surroundings of the Giralda building Slipperiness required in exterior areas Fissure in the lower area of the wall

Manolete, Marbella, CP 29660 (Málaga) Page 23 of 35 This wall is not purely containment. Its location is at the crown of the HA containment wall that runs from the garage of the Giralda building to the elevation of Adelfas street. The pathology is similar to that which occurs in the analogous wall next to the pedestrian access from the same street to the Mezquita building (subject of another report). The fissure marks the union of the HA wall with the lightweight concrete brick wall. The poor execution of this without anchors, its height, and the lateral thrusts of the curb, cause the wall to rotate, resulting in the fissure at the meeting point. 2. Surroundings of the Doñana building Fissure in the lower area of the wall Collapse of the containment wall DOÑANA

The typology of the wall, made of lightweight concrete blocks, is clearly inadequate, and therefore, it has not been able to withstand the lateral thrusts caused by the earth and vegetation of large size next to it. The descent of part of this element is caused by a deficient support, which in this case has its origin in the fact that the support substrate is probably the filling material, which MEZQUITA ALHAMBRA Affected path Affected path MEZQUITA Vehicle ramp

Manolete, Marbella, CP 29660 (Málaga) Page 27 of 35 1.6 CONCLUSIONS Based on the above, it can be concluded: • The solution adopted for the slab edge with the metal plate making the lower edge act as a drip is not appropriate. Due to the metallic nature of the element, the absence or difficulty of maintenance, and the proximity to the sea, it causes the vast majority of these elements to be oxidized to a greater or lesser extent. The oxidation of this element, with the expansive process it entails, is leading to the deterioration of the coating and the patching of the slab edge, which can cause the mortar to come off and even the plaster that covers the slab edge to come off. • In relation to the “sub-case” of slab edges defined earlier, where the exterior brickwork (either a garden wall or a terrace parapet) presents some instability due to poor support, it is understood that this corresponds to isolated cases associated with a originally precarious construction in some points. In this sense, in areas where these plates are removed, it will be necessary for a competent technician to check the geometry of the support and thus be able to detect these situations and act accordingly. Manolete, Marbella, CP 29660 (Málaga) Page 28 of 35 • The original waterproofing of many terraces and gardens has an age that varies between 24-25 years. It is for this reason that in areas where signs of filtration are present, it is understood that the complete restoration of the affected cover/garden is necessary. According to what has been found in the various visits, some neighbors have eliminated the garden, transforming the surface that previously occupied this element into a terrace. According to the maintenance managers, in several apartments this type of action has been carried out with the authorization of the Owners’ Association. In residential complexes where part of the occupation is temporary and the maintenance of private areas is very limited, it is understood that the option of eliminating gardens or emptying them and installing pots in their interior can be an interesting option for all parties. It is also important to note that the existing gardens next to the private terraces, with a depth of approximately 45-50cm, are suitable for floral-type vegetation. In several points of the community, it has been possible to appreciate vegetation of inadequate size, which undoubtedly contributes to the failure of the garden. Garden eliminated Garden emptied

Manolete, Marbella, CP 29660 (Málaga) Page 29 of 35 • In relation to the protections against falls to different levels, as mentioned earlier, the non-compliance with the current regulations does not obligate the Owners’ Association to modify the height and composition of these. However, it is urged that whoever proceeds, undertake some improvements based on the use that each owner makes of the private terraces: o Increase the height of the protection as much as possible, as some neighbors have already done. o In areas where the presence of children is frequent, install latticework or other elements that eliminate the possibility of climbing using the horizontal bars. It can be seen how some neighbors have chosen the same model of “diamond-shaped latticework” that exists in other areas of the community. • The fact that the pavement is not anti-slip and the peculiar situation that arises from the existence of areas with anti-slip pavement and others that do not, and the contrast between both, does not cease to constitute a notable risk for the user. In this sense, it is considered highly recommended to replace the pavement. Although it is true that this action may not be among the priorities of the Conjunto Señorío de Aloha, it could be planned in phases, grouping large areas with the aim of giving them the greatest homogeneity possible (by blocks, by areas according to use such as access to swimming pools, …). • In relation to the problems existing in walls, these will have to be demolished and rebuilt as specified in 1.7.4 Various in common areas: flooring, walls, and paths Supplemental Latticework

After removing the ceramic brick patching, the surface will be sanitized and a new patching of ceramic brick will be installed, with a maximum detachment of 5cm, in order to lighten this element. Extract from 3. Plans In cases where the parapet or garden wall presents some instability, this element will have to be demolished. In addition to removing the elements attached to the slab edge, the brickwork of the parapet and the affected cover-garden will have to be demolished: Extract from 3. Plans 1.7.2 Filtrations in covers/gardens Replacement of the gardens and affected covers. It is also proposed to carry out a series of filling tests in elements where there is doubt that the failure is due to the waterproofing of the terrace or that the water has simply entered through a nearby garden, the expansion joint, or through fissures/cracks in the parapet, since they do not have coping stones or an element that protects them. The terraces and gardens on which action is taken appear specified in 3. PLANS

Plans 1.7.3 Protections against falls In relation to the protections against falls, it is contemplated to paint these elements within the general painting of the urbanization. A detailed study of the different cases and situations is necessary, and this task is not part of the scope of this report. It is necessary that the Owners’ Association sets guidelines since these modifications can alter the façade of the building in a notable way.

Manolete, Marbella, CP 29660 (Málaga) Page 32 of 35 1.7.4 Various in common areas: flooring, walls, and paths • FLOORING The proposal regarding the flooring contemplates the total lifting of the flooring in the entirety of the complex, although it may not be a priority for the Owners’ Association. In that case, it would make sense to undertake it first in ramps and stairs, since these are the areas where this improvement can have the most impact, and thus dispense with the anti-slip adhesives that the Owners’ Association has installed. • WALLS (containment systems) There are two cases of different nature in this section. 1. Surroundings of the Giralda building For the collapse and fissures of the existing wall on the HA containment wall next to the Giralda building, it is prescribed to demolish and correctly execute the same. For this, it will be necessary: o Demolition of the wall, recovering the steel protections. o Demolition of a minimum strip of the curb, in order to be able to place the corresponding expansion joint that prevents the lateral thrusts of the curb from affecting the stability of the wall in the future. o Installation of anchor bolts on the HA wall, which ensure the stability of the new wall to be executed. o Execution of the new wall, plastered and painted in a similar way to the rest of the existing wall. 2. Surroundings of the Doñana building For the collapse and general failure of the containment wall, it is prescribed to completely eliminate the wall and execute a new one made of HA, with its corresponding HA foundation. For this, it will be necessary: o Demolition of the wall. o Excavation until the depth that guarantees the correct support on competent substrate is reached. o Realization of the foundation and elevation of the HA wall. o Waterproofing of the wall. o Installation of drainage systems

For this, it will be necessary: o Demolition of the pavement and the HA slab that serves as support for the pavement o Excavation for the new HA slab base o Compaction of the terrain. o Improvement layer of the terrain (Gravel). o Execution of the new slab. o Formation of steps where necessary, as well as the pavement. o Formation of protections and railings.
