Quorum and constitution

The Extraordinary General Meeting of Comunidad de Propietarios Conjunto Señorío de Aloha was held on 5 March 2026 on second call, with the quorum present sufficient for the meeting to proceed. The meeting was presided over by the President, with the administrator from Adenjo Gestión SL acting as secretary.

The administrator presented the national and regional legal framework requiring communities of owners to regulate short-term tourist rentals. Under the Andalucían decree on Viviendas de Uso Turístico (VUT) and the national Número de Registro de Alojamiento (NRA) system, apartments offered as short-term tourist accommodation must hold a VUT licence from the Junta de Andalucía and be registered in the NRA database. Communities of owners are entitled to establish their own additional regulations governing such rentals.

The community’s legal advisor confirmed that the proposed regulations are compatible with the applicable legal framework and that a qualified majority (three-fifths of owners and coefficients) was required for adoption.

Item 2 — Approval of the Short-Term Rental Regulations

The Short-Term Rental Regulations (Normativa de Alquiler a Corto Plazo), circulated to owners with the meeting notice as Annex 1, were presented in full. The regulations cover: the VUT/NRA registration process, obligations of owners who operate short-term rentals, guest rules regarding noise, communal area use, and check-in/check-out procedures, the 10% community fee surcharge for VUT-licensed apartments, and the enforcement and sanctions framework in Appendix C.

A period of questions was held in which owners raised points about the definition of short-term versus medium-term rental, the treatment of existing VUT licences, and the practical operation of the surcharge. The administrator provided clarifying responses.

Approved by qualified majority.

The regulations take effect immediately upon signature of the minutes.

Item 3 — Appointment of enforcement committee

To oversee compliance with the Short-Term Rental Regulations, a committee of three owner representatives was proposed to work alongside the administrator. The committee will review NRA registration confirmations, receive reports of alleged breaches, and initiate the formal sanctions procedure under Appendix C where appropriate.

Item 4 — Confirmation of the 10% VUT fee surcharge

The 10% community fee surcharge applicable to apartments holding a valid VUT licence, previously approved at an extraordinary meeting, was formally confirmed as incorporated into the Short-Term Rental Regulations. The administrator will issue revised fee schedules to all affected owners following registration of their VUT licences.

Item 5 — Questions and comments

Owners asked about the timeline for existing VUT-licence holders to comply with the NRA registration requirement. The administrator confirmed that a transitional period of 90 days would apply, after which non-compliant rentals would be subject to the sanctions framework. Several owners requested clarification on the community’s position regarding platforms such as Airbnb and Booking.com; the administrator confirmed that use of any platform does not exempt the owner from the NRA registration requirement.
