Why these regulations are needed
Dear owners,
As you will be aware, the Spanish government and the Junta de Andalucía have introduced new requirements for the registration of short-term tourist rentals under the national Número de Registro de Alojamiento (NRA) system. Any apartment offered for rent on platforms such as Airbnb, Booking.com, or similar services, or through private arrangement for periods of fewer than 31 days, must hold a Vivienda de Uso Turístico (VUT) licence from the Junta de Andalucía and be registered in the NRA database.
Communities of owners are expressly entitled under the Horizontal Property Act to adopt their own additional regulations governing how such rentals operate within the community. The board has determined that establishing a clear, fair framework is in the interest of all owners — both those who do rent and those who do not.
What the regulations cover
The proposed regulations, attached as Annex 1 to the EGM notice, set out:
- The process for obtaining community approval to operate a short-term rental (VUT licence from Junta de Andalucía, followed by NRA registration notified to the administrator).
- Guest obligations regarding noise, communal area use (pool, gym, reception), and check-in/check-out times.
- The 10% community fee surcharge applicable to apartments holding a VUT licence. This surcharge was approved at a prior extraordinary meeting and is incorporated into these regulations.
- The enforcement and sanctions process (Appendix C), to be operated by an enforcement committee of three elected owner representatives.
These regulations do not prohibit short-term rental. They establish a lawful, transparent framework under which owners who wish to rent may do so with community approval.
Impact on owners who rent
If you currently hold a VUT licence or intend to apply for one, you will need to:
- Notify Adenjo Gestión SL of your VUT licence number.
- Complete the NRA registration process and provide the registration number to the administrator.
- Ensure your guests receive and comply with the community guest rules.
A transitional period of 90 days from adoption of the regulations will be available for existing VUT-licence holders to complete the NRA registration process.
Next steps
The EGM will be held on 5 March 2026 at 10:00 (first call) / 10:30 (second call). A qualified majority of three-fifths of owners and participation coefficients is required to adopt the regulations.
